1. About Orbitelo

Orbitelo is a digital platform designed to help users discover, purchase, and manage eSIM data plans for international travel. The Service is operated by Orbitelo Labs, LLC, a limited liability company incorporated in the State of Delaware, United States.

Orbitelo does not operate mobile networks. Connectivity services are provided by third-party eSIM and telecommunications partners.

2. Eligibility

You must be at least 18 years old to use the Service. Orbitelo involves purchasing digital products using payment methods, which requires users to be legal adults.

By using Orbitelo, you confirm that you meet this age requirement. If we become aware that a user is under 18, we will suspend their account and delete any associated personal data.

3. Use of the Service

You agree to use the Service only for lawful purposes and in accordance with these Terms.

You agree not to:

• Misuse, disrupt, or interfere with the Service
• Attempt unauthorized access to systems or data
• Use the Service for fraudulent or illegal activities

We reserve the right to suspend or terminate access if misuse is detected.

In addition, if a payment dispute (chargeback) is opened or our payment provider's fraud detection flags a charge, access to your active eSIM service may be automatically paused. Service will be restored if the dispute is resolved in your favor.

4. eSIM Plans & Connectivity

• eSIM plans are offered through third-party providers
• Coverage, speeds, availability, and performance may vary by location and local operator conditions
• Orbitelo does not guarantee uninterrupted or error-free connectivity
• Network speed (4G/5G/LTE) is not guaranteed and depends on the local operator

Device compatibility: You are responsible for ensuring your device supports eSIM technology and is carrier-unlocked before purchasing. Orbitelo is not responsible for issues arising from device incompatibility or a locked device.

5. eSIM Activation

Your eSIM plan activates automatically when your device first connects to a supported mobile network included in your plan. At that moment, the plan validity period begins immediately and cannot be paused or extended.

Roaming activation notice: If your purchased plan includes coverage in your current location at the time of installation, the eSIM may activate immediately upon connecting to a local network. To avoid unintended early activation, install your eSIM only when you are ready to use it, or disable data roaming on your device until you reach your destination.

Once an eSIM plan has activated, it is considered used regardless of the amount of data consumed.

6. Pricing & Payments

• Prices, plan details, and availability are displayed before purchase
• Prices are shown in your selected currency; the final charge depends on your payment method and may include conversion fees applied by your bank
• Taxes or fees may apply depending on your location
• Payments are processed securely by Stripe. By completing a purchase, you also agree to Stripe's terms

Orbitelo is not responsible for issues caused by payment processors or bank-side currency conversions.

7. Refunds & Cancellations

Refund eligibility depends on the activation status of your eSIM:

• Not yet installed: Refund may be requested within 60 days of purchase
• Installed but not yet activated: Reviewed on a case-by-case basis
• Activated: No refund. Once an eSIM has made its first network connection, the plan is considered used and is non-refundable

Refunds may also be considered if a verified technical issue prevents all usage and is confirmed by Orbitelo support.

8. Intellectual Property

All content, branding, logos, and software related to Orbitelo are owned by Orbitelo or its licensors.

You may not copy, modify, distribute, or reproduce any part of the Service without prior written permission.

9. Limitation of Liability

To the maximum extent permitted by law, Orbitelo shall not be liable for:

• Network outages or connectivity issues
• Data loss or service interruptions
• Indirect, incidental, or consequential damages
• Issues caused by third-party providers or device incompatibility
• Early or unintended eSIM activation due to device roaming settings

Use of the Service is at your own risk.

10. Third-Party Services

Orbitelo may include links or integrations with third-party services including eSIM network providers, payment processors, and analytics tools. We are not responsible for their content, policies, or practices.

11. Changes to These Terms

We may update these Terms from time to time.

When we do, we will revise the 'Last updated' date. Continued use of the Service after changes means you accept the updated Terms.

12. Termination

We may suspend or terminate access to the Service at any time, with or without notice, if these Terms are violated.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.
